Welcome to “Duomi Market Review” (the “App”). The App is developed and operated by 金栋君 (Jindongjun Jin) (“we,” “us,” or “our”).
Please read and fully understand this Agreement before using the App, particularly the bold provisions concerning limitations of liability, paid services, and dispute resolution. By downloading, installing, opening, or continuing to use the App, you acknowledge that you have read and agreed to this Agreement. If you do not agree, please stop using and uninstall the App.
1. Services
- The App is a market review journaling tool that provides review notebooks, market-condition records, custom metrics, capital-flow sector records, trend views, iCloud synchronization, and other supporting features.
- The App may offer free features, auto-renewable subscriptions, one-time purchases, and other services. The scope, price, duration, and promotions applicable to each offering are as displayed on the purchase page and the App Store.
- We may update, adjust, or discontinue certain features based on product and operational needs. We will provide appropriate notice of changes that materially affect your rights and will protect rights you have already acquired as required by law.
- The App does not require a separate Duomi Market Review account. iCloud synchronization and in-app purchases are supported by your Apple Account and services provided by Apple.
2. License and Rules of Use
- Subject to your compliance with this Agreement, we grant you a personal, limited, non-exclusive, and non-transferable license to install and use the App solely on Apple devices that you own or control.
- You must not:
- violate applicable laws or infringe the lawful rights of others;
- copy, sell, rent, sublicense, or commercially exploit the App without authorization;
- reverse engineer, decompile, crack, or circumvent technical protection measures, except to the extent such restrictions are prohibited by law;
- interfere with the normal operation of the App, Apple services, or related networks;
- use the App to store or distribute unlawful, harmful, infringing, or malicious content; or
- impersonate another person or fraudulently make purchases, request refunds, or restore entitlements.
- You are responsible for safeguarding your devices and Apple Account. If a device is lost, an account is compromised, or unauthorized use occurs, promptly contact Apple and take appropriate security measures.
3. Content and Intellectual Property
- The software, interface, graphics, logos, text, arrangement, and related intellectual property in the App belong to us or their respective rights holders. You may not use them beyond the scope permitted by this Agreement without authorization.
- You or the original rights holder retain lawful rights in the review notes, metric names and values, and other content you enter into the App. You are responsible for ensuring that such content is lawfully sourced and does not infringe the rights of others.
- To provide local storage and iCloud synchronization, you authorize the App to store, access, synchronize, and display your content to the extent necessary to provide those features. This authorization does not transfer ownership of your content to us.
4. Memberships, Purchases, and Auto-Renewal
- The App may currently offer the following in-app purchases:
- Annual Membership: an auto-renewable subscription. The subscription period, price, and benefits are as displayed on the purchase page.
- Lifetime Membership: a one-time, non-consumable purchase that provides access to the applicable features for as long as the App and corresponding service remain available and your purchase entitlement remains validly associated with you.
- All purchases are completed through Apple’s App Store and StoreKit. Apple processes payments, billing, taxes, orders, and refunds. We do not directly receive your full payment-card details.
- Annual Membership renews automatically until canceled. Apple generally charges your Apple Account for the next period within 24 hours before the end of the current subscription period. You can manage or cancel the subscription on your iPhone or iPad under Settings > your name > Subscriptions. To avoid renewal, cancel in time under Apple’s then-current rules.
- After you turn off auto-renewal, you can generally continue using membership benefits through the end of the paid period. Uninstalling the App does not automatically cancel a subscription.
- Apple handles refunds under its rules and applicable law. You may request a refund through Apple’s Report a Problem page.
- After changing devices or reinstalling the App, you may use “Restore Purchases” in the App to restore valid purchase entitlements associated with the same Apple Account. Family Sharing availability depends on the App Store settings for the specific product.
- If pricing, benefits, or renewal terms change, we or Apple will display or communicate the change in accordance with applicable law and App Store rules. Where renewed consent is legally required, the change will take effect only after you provide it.
- “Lifetime” refers to the operating life of the App and the applicable service. It is not a promise tied to any person’s lifespan, perpetual online service, or permanent compatibility with every future operating-system version, except where mandatory law provides otherwise.
5. Important Investment Risk Notice
- The App is solely a recording and organization tool. It does not provide investment advice, trading recommendations, guaranteed returns, discretionary asset management, market trading services, or advice concerning securities, funds, futures, foreign exchange, digital assets, or other financial products.
- Preset metrics, trend charts, historical records, and content you enter are intended only for personal review and do not constitute a recommendation to buy, sell, hold, or allocate any asset.
- Financial markets involve risk. You must exercise independent judgment based on your own circumstances and bear the consequences of your investment decisions. Except for liability that cannot legally be excluded, we are not responsible for trading losses arising from decisions you make based on records or displays in the App.
6. Data, iCloud, and Backups
- Your review data is generally stored locally on your device. When your device is signed in to iCloud, iCloud is enabled for the App, and system conditions permit, the data is stored in and synchronized through your private iCloud database using Apple CloudKit.
- Apple provides iCloud subject to Apple’s terms and privacy policy. Synchronization speed, availability, storage capacity, and data-recovery capabilities may be affected by Apple services, network conditions, system settings, and account status.
- You should maintain appropriate backups of important records. To the extent permitted by law, our responsibility for delay, conflict, or loss of data caused by device failure, accidental deletion, abnormal Apple Account or iCloud status, network interruption, system upgrades, or force majeure will correspond to our degree of fault.
- If “Data Backup and Restore” in the App is marked incomplete or experimental, it must not be treated as an available standalone backup solution.
- For information about how we process data, see the Duomi Market Review Privacy Policy, which forms an integral part of this Agreement.
7. Third-Party Services and External Links
- The App uses Apple services including iCloud/CloudKit, the App Store, and StoreKit, and may include links to Apple, Xiaohongshu, email, or other external services.
- Third parties operate their services independently. When accessing or using a third-party service, you must also comply with its terms and privacy rules. We do not control the content, availability, or data-processing practices of third-party services, but remain responsible as required by law for our selection and integration of such services.
8. Changes, Interruptions, and Termination
- We may update or temporarily interrupt services to maintain security, fix faults, support operating systems, or comply with legal requirements.
- If you materially violate this Agreement or applicable law, we may restrict or terminate your access to relevant services to the extent permitted by law, without improperly affecting your statutory consumer rights.
- You may stop using and uninstall the App at any time. Uninstalling the App does not cancel a subscription and may not delete data already synchronized to iCloud. Manage subscriptions and iCloud data separately.
9. Disclaimers and Limitation of Liability
- We take reasonable measures to keep the App secure and stable, but cannot guarantee uninterrupted or error-free service or availability on every device, operating-system version, and network environment.
- If services are disrupted by force majeure, underlying communication failures, Apple service outages, system maintenance, cyberattacks, or other events beyond our reasonable control, we will use reasonable efforts to mitigate the impact.
- Nothing in this Agreement excludes or limits liability arising from our willful misconduct or gross negligence, liability that cannot be excluded or limited by law, or your statutory consumer rights.
10. Use by Minors
The App is not specifically directed to children under 14. Minors should use the App only after a parent or guardian has read and agreed to this Agreement, and should not enter their own or another person’s sensitive personal information in review notes. A guardian with questions about a minor’s use or the processing of information may contact us using the details below.
11. Updates to This Agreement
We may update this Agreement to reflect changes in features, laws, regulations, or service models. We will communicate material changes through an in-app notice, release notes, or another reasonable method. Updated terms apply from the stated effective date. Where separate consent is required by law, we will obtain it.
12. Governing Law and Dispute Resolution
- The formation, validity, performance, and interpretation of this Agreement are governed by the laws of Mainland China, without excluding mandatory consumer-protection rules applicable in your place of residence.
- The parties should first attempt to resolve disputes amicably. If no resolution is reached, you may complain to an appropriate consumer-protection organization or regulator, or bring proceedings before a court of competent jurisdiction as permitted by law.

14. Apple-Specific Terms
- This Agreement is between you and us, not Apple. We, rather than Apple, are responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to an applicable warranty, you may notify Apple. To the extent permitted under applicable rules, Apple may refund the applicable purchase price and will have no other warranty obligation.
- To the extent required under the applicable Apple end-user license terms, Apple and its subsidiaries are third-party beneficiaries of the relevant license provisions in this Agreement and may enforce those provisions.
- Matters not addressed by this Agreement are also subject to the Apple Media Services Terms and Conditions applicable in your region and Apple’s other applicable rules. Where this Agreement conflicts with mandatory Apple rules, those rules prevail.
